Domestic Violence Court - Nanaimo
Specialized court responding to the needs of people experiencing intimate partner violence. The primary objective of the court is to stop violence in relationships and keep families safe. Employs a therapeutic or problem-solving model to sentencing offenders who plead guilty to domestic violence offences, in which service providers attend court to provide services for both victims and offenders. Problem-solving courts try to help people with the underlying problems contributing to their criminal behaviour, but still hold them accountable. Police submit files to a designated Crown prosecutor within two weeks of responding to a domestic violence complaint. Corresponding information is offered to the judge to make sentencing more effective. The prosecutor contacts complainants immediately and refers them to helpful services. If children are involved the prosecutor also liaises with Ministry of Children and Family Development (MCFD). And, in high-risk cases, an Inter-Agency Case Assessment Team meets to discuss a safety plan. During the two-week processing period, families are linked to therapeutic services. Once the matter comes to court, free or low-cost services are available at the courthouse for both accused persons and complainants including Crown counsel, Native Court Worker, counselling providers, community-based victim services, and referrals to community services.
